How the Fourth Amendment Works
When evidence against you has been obtained through an illegal search or seizure, your attorney should make a motion to suppress the evidence against you. This applies whether you have been arrested for DWI, drug possession, or a federal white collar crime.
If a court finds that a stop of your vehicle or search of your home was illegal, evidence obtained from that stop or search may not be used against you. Simply put, a Fourth Amendment violation could severely weaken or altogether destroy the Government's case against you.

Many times, law enforcement will not only arrest you but will also attempt to seize property they deem to be "contraband." This seizure process if initiated by law enforcement filing a Notice of Seizure and Intended Forfeiture. Under state law, contraband is any item derived from or used in the commission of a list of specified criminal offenses. If you have received a Notice of Seizure and Intended Forfeiture, it is critical that you seek the help of an experienced criminal defense attorney. Once that Notice is filed, you have limited amount of time to answer to these allegations before the State of Texas is permitted to keep your property.
